Amendments |
The Uniform
Code of Bylaws contains those basic elements of the Constitution,
Bylaws and Uniform Code of Bylaws of the York Rite Sovereign College
that every York Rite College must have in its Bylaws. Options consistent
with the Sovereign College Regulations have been added as permitted
by the Uniform Code of Bylaws and approved by the Governor General.
This York
Rite College hereby declares its fealty to the Most Worshipful Grand
Lodge of Texas, and to the York Rite Sovereign College of North America.
ARTICLE
I
NAME, NUMBER AND LOCATION
A. This College
shall be known as Texian York Rite College No. 60.
B. The City
of San Antonio, State of Texas, shalI be the home or the usual Assembly
place, of this College.
C. Jurisdiction
of this College shall be as prescribed by the York Rite Sovereign
College Regulations.
ARTICLE
II
FISCAL OR COLLEGE YEAR
A. The fiscal
year of this College shall begin on I June and end on 31 May of the
following year.
ARTICLE
III
PURPOSES
A. The purposes
of this York Rite College shall be:
- To foster a spirit of
cooperation and consideration among each of the Bodies of York Rite
Masonry.
- To assist in worthy efforts
to improve the ritualistic and dramatic presentation of York Rite
Work.
- To conduct an educational
program in order to inculcate greater appreciation of York Rite Masonry.
- To strengthen York Rite
Masonry in every way possible.
- To build up a love of
country and to aid and support genuine Patriotism.
- To reward outstanding
service to York Rite Masonry by awards, honors and other methods of
proper recognition.
ARTICLE
IV
MEMBERSHIP
A. Membership
shall be limited to Regular Members who are in good standing in a
Symbolic Lodge of Master Masons, a Chapter of Royal Arch Masons, a
Council of Cryptic Masons, and a Commandery of Knights Templar, and
who are actively engaged in working for the York Rite.
B. The Council,
acting as a Screening Committee, shall consider all Proposals for
Membership and cause them to be presented at the Assembly or be filed
by the Secretary, but a majority vote of the Assembly can bring a
Proposal up for ballot if he qualifies by "A", above.
C. Membership
in this College shall be by invitation only.
D. Any member
in good standing may recommend an eligible York Rite Mason for membership
on the Proposal Form provided for that purpose.
E. Membership
in this College shall be as follows:
- PRIMAL - Regular Member.
- DUAL - Membership in this
College plus Primal Membership in a different Grand Jurisdiction.
- PLURAL - Membership in
more than one College within this State.
F. Life (or
Prepaid) Membership.
- General:

Each
of the Chartered Colleges of the York Rite Sovereign College
of North America is authorized to establish a Life (or Prepaid)
Membership Plan in order to establish a Prepaid Dues Plan.

Each
Prepaid Dues Fund shall be the property of this College. A member's
dues must be current at the time of becoming a Prepaid member.

The
College shall not commingle any of its other assets with the
Prepaid Dues Fund. The College shall in no case borrow from
the Prepaid Dues Fund, pledge its assets as security, or loan
any part of such Prepaid Dues Fund to any individual or private
corporation.

Life
Membership Plan is adopted concurrent with the adoption and
approval of these Bylaws.

The
Life Membership cost for a member in this College shaII
be an amount equal to twenty (20) times the Annual Dues
for membership in this College, plus twenty (20) times the
Sovereign College Per Capita Tax in effect at the time of
application for Life Membership. Investment of the funds
must be consistent with investment policies of the Grand
Lodge of Texas, and must be approved in advance by the Grand
Governor, and be reported to the Sovereign college office.
G. A unanimous
vote of those members present at a Regular Assembly, or a Special
Assembly- called for that purpose, shall be necessary for election
to membership.
ARTICLE
V
COLLEGE OFFICERS
A. The Officers
of this York Rite College by Title and Rank are:
- Preeminent Governor
- Eminent Deputy Governor
- Eminent Chancellor
- Eminent Treasurer
- Eminent Secretary
- Noble Primate
- Noble Preceptor
- Noble Seneschal
- Noble Marshal
- Noble Sentinel
B. The first
five (5) shall be elected at or before the Annual Assembly.
C. The Governor
shall make all appointments.
D. The term
of office shall be one year, or until a successor is duly installed.
E. The five
(5) Elected Officers shall constitute the Council of this College.
F. It shall
be the duty and privilege of the Governor to preside at all Assemblies
of the College. In his absence the Deputy Governor, Chancellor, or
the Junior Past Governor present, in that order, will open the College
and preside.
G. Should the Office of Governor become vacant, the Deputy Governor
or Chancellor, in that order, shall succeed to the Office of Governor
until the next Annual Assembly. Should a special election become necessary,
the Governor General may grant his dispensation upon application.
H. The election
and installation of Officers must comply fully with the applicable
Sovereign College Regulations.
I. All Elected
officers shall be elected by a majority vote of the members present
at the Annual Assembly of this York Rite College, and shall be installed,
along with the Appointed Officers, on that same date.
ARTICLE
VI
ASSEMBLIES
A. The Annual
Assembly of this York Rite College shall be held in May each year.
B. In addition
to the Annual Assembly, there shall be three (3) Regular Assemblies
held in the months of August, November and February of each year,
upon written call of the York Rite Governor.

B. In addition
to the Annual Assembly, there shall be two (2) Regular Assemblies
held in the months of August and November of each year,
upon written call of the York Rite Governor.
C. The Governor
may call Special Assemblies at his discretion.
D. Nine (9)
Companion Knights shall constitute a quorum.
E. All Regular
and Special Assemblies shall convene at such time and place as designated
by the York Rite Governor in the written call. Written call of the
York Rite Governor for Assemblies of the York Rite College shall be
postmarked no later than ten (10) days prior to the date of the call
for the Assembly.
ARTICLE
VII
FEES AND DUES
A. The
Fee for Membership in this College shall be $75.00 plus the prescribed
fee to the College of $25.00. Total to accompany Application is $100.00.
The foregoing
lined-out Section A was Changed November 11, 1995 to read as follows:
A. The
Fee for Membership in this College shall be $100.00 ($75.00 plus the
prescribed fee to the Sovereign College of $25.00). Total to accompany
the application $100.00, and in addition any Per Capita or Special
Assessment levied by the York Rite Sovereign College of North America
must accompany the application.
The foregoing
lined-out Section A was Changed February 9, 2002 to read as follows:
A. The Fee
for Membership in this College shall be One Hundred Dollars ($100.00)
plus the prescribed fee payable to the Sovereign College and any additional
Per Capita or Special Assessment levied by the York Rite Sovereign
College of North America. The total Membership Fee must accompany
the application for membership.
B. The
Annual Dues for Membership in this College shall be $7.00, plus the
Sovereign College Per Capita of
$5.00 for a total of $12.00.
C. The
Fee for Affiliation shall be $50.00 and shall include the current
year's dues.
The foregoing
lined-out Sections B and C, were changed March 10, 1993 to read as
follows:
B. The
Annual Dues for Membership in the College shall be $7.00, plus the
Sovereign College Per Capita Tax in effect at time annual dues are
due and payable.
The foregoing
lined-out Section B was changed November 11, 1995 to read as follows:
B. The
Annual Dues for Membership in this College shall be Fourteen Dollars
($14.00), plus the Sovereign College Per Capita Tax in effect at the
time annual dues are due and payable, effective with the Collegiate
Year beginning June 1, 1996.
The foregoing
lined-out Section B was changed February 9, 2002 to read as follows:
B. The Annual
Dues for Membership in this College shall be Thirty Dollars ($30.00),
plus the Sovereign College Per Capita Tax in effect at the time the
Annual Dues are due and payable.
C. The Fee
for Affiliation shall be the current year's dues.
ARTICLE
VIII
COMMITTEES
A. The Council
shall serve as a Standing Committee on Charity, and may authorize
an amount not to exceed $100.00 to relieve a worthy distressed Companion
Knight.
B. Immediately
after his election, the Governor shall appoint Committees on:
- York Rite Cooperation
- Membership
- Finance
- Degree Teams
- Entertainment
- York Rite Reception
C. The Council
shall serve as an Executive Committee and shall have authority to
approve disbursements of College Funds in a sum not to exceed $200.00
in furtherance of the Purposes of the York Rite College enumerated
in Article III of these Bylaws. The Council shall have the power to
consider all the affairs of the business of the York Rite College
between the Assemblies thereof. A Quorum of the Council shall consist
of a majority of the Members of the Council, and shall meet upon the
call of the York Rite Governor or upon the Petition of at least three
(3) members of the Council.
ARTICLE
IX
DEFUNCT COLLEGES
If this College
shall cease to exist, except for the purposes of consolidation, the
Governor and the Secretary shall, within thirty (30) days thereafter,
transmit to the Secretary General of the York Rite Sovereign College
of North America all books, papers, rituals, jewels, seals, robes,
all paraphernalia, and all other property or funds, or evidence thereof,
together with the Charter, unless the same has been arrested or removed
by the order of the Governor General.
ARTICLE
X
VACANT OFFICES
A. Any Office
may be vacated in the following ways:
- Death.
- Inability or refusal to
serve.
- Temporary or permanent
suspension.
- Expulsion from the order.
- Loss of prerequisite membership.
B. Appointed
Officers serve at the pleasure of the Governor.
C. The Grand
Governor may suspend an Elected Officer failing to properly fulfill
the duties of his office (e.g., A-2, above).
ARTICLE
XI
CONFLICT DISCLAIMER
A. Anything
contained herein that is in conflict with the spirit and intent of
the Sovereign College Constitution and Bylaws, together with the guidelines
of the Governor General and the Board of Directors, is hereby declared
to be null and void.
ARTICLE
XII
AMENDMENTS
A. These Bylaws
may be amended as follows:
- The written proposal to
amend shall identify the ARTICLE, Section, Page and line(s) to be
deleted, amended or replaced.
- It shall identify the
New Amendment by ARTICLE, Section and Page.
- It shall quote the new
language exactly.
- It must be received and
passed by a majority vote at a Regular Assembly or a Special Assembly
called for that purpose.
- It must then lay over,
due notice given the membership (ARTICLE VI-E), and adopted by a 2/3
majority vote at a subsequent Assembly.
- It must be properly signed
and submitted, in triplicate to the Secretary General for the Governor
General's signature.
The foregoing
Bylaws of this York Rite College, except where amended, as shown,
were approved on June 2, 1987 by Howard Paul Bennett, the then Governor
General, and such approval is on file in the Official Records of this
College.
The amended ARTICLE, as shown, of the foregoing Bylaws, was approved
on the date shown (March 10, 1993) by the then Governor General, Roy
E. Van Delinder, Jr. and authenticated approved by the Governor General
and Secretary General, Henry A. Montague, on March 15, 1993, This
approval is also on file in the Official Records of this College.
